These terms cover what we build for you, what it costs, and what each of us is responsible for. By using Gnarlywhal or buying from us, you agree to them.
1. Who you are agreeing with
Gnarlywhal is a brand operated by Digital Star Marketing LLC ("Gnarlywhal," "we," "us"). "You" means the business owner who uses our service or buys from us.
2. What we offer
- The Shareup (Free). We build you a finished website from your real work and put it on a link. You see it before you pay. No card, no obligation.
- The Website ($500). A five-page website on your own domain, yours to keep.
- Done-for-you ($2,500). We bring your wider presence up to speed: your Google Business Profile, social profiles, name-and-address consistency, a professional refresh, and the setup the Engine needs.
- The Engine ($99 per month). Once a week we text you, report your results, and keep your website, Google profile, and reviews current. Cancel any time.
Prices are in US dollars and may change for new orders. The price you agree to at purchase is the price you pay for that purchase.
3. The free preview comes with no strings
We build your Shareup before you pay and before we ask for anything. You are never obligated to buy. If you love it, you keep it for $500. If you do not, you owe us nothing.
4. Payment and billing
- The Website ($500) and Done-for-you ($2,500) are one-time payments.
- The Engine is $99 per month, billed monthly until you cancel. You can cancel any time and you will not be billed for the next cycle.
- Fair use: the Engine includes a reasonable cap on customer-facing texts. If your usage is far beyond normal, we will talk to you before charging more.
5. The 10% donation
We give 10% of what you pay to a cause you choose. This is part of the deal, not a marketing gimmick. The donation is real and made in your business's name.
6. The footer credit
Every site we build carries a small "Built by Gnarlywhal" credit in the footer that links back to us. This credit stays on, at every tier. It is how good businesses find us, and it is not removable. By using Gnarlywhal you agree to keep it in place.
7. Your responsibilities
- Give us accurate information about your business. You are responsible for what you tell us is true.
- If you sign up for Done-for-you or the Engine, you grant us permission to access and update the accounts you connect (such as your Google Business Profile) on your behalf. You can withdraw that access at any time.
- Only ask us to publish things you have the right to publish.
- Keep your Engine replies and account access to yourself.
8. Who owns what
You own your content: your business information, your photos, your reviews, and the words about your business. When your site is paid for, it is yours. You grant us the permission we need to build, host, publish, and maintain it for you, and to use AI tools to do that work.
We own the Gnarlywhal name, our methods, our templates, our code, and the systems behind the Engine. Buying a website does not give you ownership of those.
9. Results are not guaranteed
We are proud of what our sites do, and we will show you real results from real clients. But search rankings, traffic, leads, and revenue depend on many things outside our control, including Google, your market, and your own business. We do not guarantee any specific ranking, position in AI answers, number of leads, or revenue. Examples we share are real outcomes for specific businesses, not promises of what you will get.
10. Things we cannot promise
We work hard to keep everything running, but we provide our service "as is." We do not promise it will always be uninterrupted or error-free, and we are not responsible for the services of third parties such as Google, your hosting provider, or your phone carrier.
11. Limit of our responsibility
To the fullest extent the law allows, Gnarlywhal and Digital Star Marketing LLC are not liable for indirect or consequential losses, such as lost profits or lost business. If we are ever found liable, our total responsibility to you will not exceed the amount you paid us in the prior twelve months.
12. Ending the agreement
You can stop using the Engine any time by cancelling. We may suspend or end service if these terms are broken or if the service is misused. If we end your Engine subscription, we will not bill you further.
13. The law that applies
These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute will be handled in the courts located in North Carolina.
14. Changes to these terms
We may update these terms. When we do, we will change the date at the top of this page. If a change is significant, we will do our best to tell you directly.
